The Supreme Court on Tuesday criticized an Allahabad High Court order that implied a rape victim had “invited trouble.” A bench led by Justice BR Gavai described the observations as highly insensitive.
The Allahabad High Court had granted bail to a rape accused, stating that the complainant had willingly gone to the accused’s house after consuming alcohol, thereby “inviting trouble.” This controversial order drew further attention just days after the Supreme Court stayed a similarly insensitive judgment in another attempted rape case.

The order, passed last month by Justice Sanjay Kumar Singh, also noted that the woman—an MA student—was “competent enough to understand the morality and significance of her act.”
